Privacy Policy

Effective Date: June 30, 2026 Last Updated: June 30, 2026

This Privacy Policy explains how MyoAirway ("we," "us," or "our"), operated by Myoairway, collects, uses, and protects information when you visit www.fixmybreathing.com (the "Site").

This policy applies only to information collected through this Site. It does not govern how we handle Protected Health Information (PHI) for established patients, which is addressed separately in our Notice of Privacy Practices under HIPAA. See "A Note on Health Information" below for the distinction.

1. Information We Collect

Information you provide directly

When you submit our referral or contact form, we collect:

  • Your name

  • Email address and/or phone number

  • The general reason for your inquiry or referral (as you choose to describe it)

We do not request or require detailed medical history, diagnoses, or other clinical information through this form. If you choose to include such details voluntarily, see Section 7 below.

Information collected automatically

Like most websites, we (and our hosting platform, Wix) automatically collect certain technical information when you visit, including:

  • IP address

  • Browser type and device information

  • Pages visited and time spent on the Site

  • Referring website/source

  • Cookie and similar tracking data (see Section 3)

2. How We Use Your Information

We use the information collected to:

  • Respond to your inquiry or referral request

  • Schedule or coordinate care, if you become a patient

  • Maintain and improve the security, performance, and usability of the Site

  • Comply with legal obligations

We do not sell your personal information, and we do not use form submissions for unrelated marketing without your separate, explicit consent.

Legal basis for processing (for EU/UK visitors)

Where the General Data Protection Regulation (GDPR) applies, we process your information based on:

  • Consent — when you voluntarily submit the contact/referral form

  • Legitimate interest — to operate, secure, and improve the Site

  • Legal obligation — where required by applicable law

You may withdraw consent at any time by contacting us (Section 8).

3. Cookies and Tracking Technologies

4. How We Share Information

We do not sell your personal information. We may share limited information with:

  • Service providers who help us operate the Site (e.g., Wix as our website host, our cookie consent provider, email/scheduling tools), bound by confidentiality and data protection obligations

  • Legal authorities, if required by law, subpoena, or to protect health, safety, or legal rights

  • Successor entities, in the event of a business transfer (e.g., sale of the practice), subject to this policy or a comparable one

5. Data Retention

We retain referral/contact form submissions only as long as necessary to respond to your inquiry and for legitimate business or legal record-keeping purposes, after which it is securely deleted or anonymized. If you become a patient, your clinical records are retained according to applicable healthcare recordkeeping laws, separate from this Site's data.

7. A Note on Health Information

This Site and its referral/contact form are not intended to collect Protected Health Information (PHI) as defined under HIPAA. Please do not include sensitive medical details, diagnoses, or treatment history in website form submissions.

Once you become an established patient, your clinical records, treatment notes, and health information are handled in accordance with our HIPAA Notice of Privacy Practices, which is provided separately and governs that information — not this website Privacy Policy.

8. Children's Privacy

This Site is intended for use by adults (e.g., parents/guardians submitting a referral on behalf of a child). We do not knowingly collect personal information directly from children under 13 through this Site. Forms submitted on behalf of a minor patient are submitted by the parent or guardian.

9. International Data Transfers

If you are accessing this Site from outside the United States, please be aware that information you provide will be transferred to and processed in the United States, where data protection laws may differ from those in your jurisdiction.

10. Security

We use reasonable administrative, technical, and physical safeguards to protect information submitted through this Site. However, no method of transmission over the internet is 100% secure, and we cannot guarantee absolute security.

11. Changes to This Policy

We may update this Privacy Policy periodically. The "Last Updated" date above reflects the most recent revision. Material changes will be reflected on this page.
